Patron sues local restaurant for negligence after fall

A local business is facing serious allegations of negligence after a woman claims she was injured on their property. Elizabeth Blevins filed a complaint against Dairyland One, LLC in the Court of Common Pleas of York County, Pennsylvania, on July 9, 2024.

According to the court documents, Blevins alleges that she suffered significant injuries due to Dairyland One's failure to maintain safe premises at their Dairyland Family Restaurant located in Red Lion, Pennsylvania. The incident occurred on November 14, 2023, when Blevins tripped and fell on a sloped curb while attempting to enter the restaurant. The plaintiff asserts that this accident resulted from Dairyland One's negligence in several areas including "failing to recognize the special element of harm and danger of the sloped curbing" and "failing to properly paint the sloped curb."

Blevins' complaint details how she believes Dairyland One neglected its duty of care by not addressing or warning about the hazardous condition posed by the improperly sloped curb. She accuses them of failing to maintain a safe environment for business invitees like herself and allowing dangerous conditions to persist without adequate warnings or corrective measures. Specifically, Blevins claims that there were no warning signs or painted indicators on the curb which led her to trip and sustain injuries including facial pain, bilateral knee injury, neck injury, and severe shock to her nervous system.

The lawsuit further elaborates that as a result of these injuries, Blevins has incurred substantial medical expenses and anticipates future costs related to ongoing treatment. Additionally, she has experienced considerable physical and mental suffering which has significantly impacted her daily life activities.

Blevins is seeking a judgment against Dairyland One in an amount exceeding the mandatory arbitration limits. She demands compensation for her medical expenses, pain and suffering, mental anguish, loss of life's pleasures, and other related damages.
