Delaware Resident Alleges Negligence Against Pennsylvania Company Over Unsafe Premises

A Delaware resident has filed a lawsuit against a Pennsylvania-based company, alleging negligence that led to severe personal injuries. On August 8, 2024, Nadine Brinson filed the complaint in the Court of Common Pleas of Delaware County against AV Siding, LLC.

According to the complaint, Brinson was on the premises of AV Siding, LLC at 405 Farview Avenue, Newtown Square, PA on October 19, 2023. She alleges that while trying to avoid an electrical extension cord on the steps, she tripped and fell due to a defective paver stone. The plaintiff claims that this incident resulted in serious and permanent injuries including head trauma, neck injuries, and a sprained right wrist. The complaint states that AV Siding had a duty to maintain the premises in a reasonably safe condition but failed to do so.

The lawsuit accuses AV Siding of multiple counts of negligence. Specific allegations include failure to design, construct, maintain, and repair the premises properly; failure to inspect or clean the area; failure to provide adequate warnings about dangerous conditions; and failure to comply with local building codes. The plaintiff asserts that these failures directly led to her fall and subsequent injuries. "The negligence and/or carelessness of the Defendant was the direct and sole cause of the poorly maintained steps on the premises," reads one part of the complaint.

Brinson is seeking judgment in excess of $75,000 plus costs from AV Siding for her medical expenses, loss of earnings capacity, emotional distress, and other related damages. She argues that her injuries are permanent and have caused significant financial detriment.

Representing Brinson are attorneys Marc I. Simon and his team from Simon & Simon P.C., while AV Siding's defense includes Kane Daly among others.
