Plaintiffs Injured in Car Accident Sue Driver for Negligence

A devastating car accident has led to a significant legal battle, as two plaintiffs seek justice for the injuries they sustained. On August 6, 2024, Flavio Alonzo and Noe Mati Alonzo Hernandez filed a complaint in the United States District Court for the Eastern District of Pennsylvania against Kristina Pena.

The incident in question occurred on September 9, 2022. According to the complaint, Flavio Alonzo was a passenger in a vehicle driven by Noe Mati Alonzo Hernandez when they were struck by Kristina Pena's car at an intersection. The collision took place at Second Street Pike and Penns Park Road, resulting in both plaintiffs being transported to Doylestown Hospital with severe injuries. The plaintiffs allege that Pena failed to exercise due care while driving, listing several specific acts of negligence including failure to control her vehicle properly and improperly entering an intersection.

The plaintiffs argue that Pena's negligence has caused them significant physical pain and mental anguish. They claim their injuries are serious and permanent, affecting their ability to perform daily activities and work duties. Both have incurred substantial medical expenses as a result of the accident and expect these costs to continue into the future. Additionally, because neither plaintiff is a resident of Pennsylvania nor was their vehicle registered there at the time of the accident, they assert that their medical bills are recoverable under state law.

In their filing, Alonzo and Hernandez seek compensatory damages from Pena for their medical expenses, pain and suffering, lost wages, and other related costs. They also request interest and coverage of court costs. Represented by attorney Kevin Riechelson from Cohen & Riechelson law firm in Hamilton, New Jersey, they demand a jury trial to resolve the matter.

This case will be presided over by judges from the Eastern District of Pennsylvania under Case ID 2:24-cv-03836.
