Battle for bathroom in Subway results in lawsuit

PITTSBURGH - An altercation in a restaurant bathroom has a West Mifflin man suing Subway and FedEx.

A lawsuit was filed in July in the Court of Common Pleas of Allegheny County by Leonard Wargo against Lee McGinnis Jr., Subway, and FedEx Ground, FedEx, and FedEx Corporation. 

The plaintiff alleges that on October 27, 2023, he was violently assaulted by McGinnis at a Subway restaurant located at 1325 Hoffman Boulevard in West Mifflin. 

Wargo claims that McGinnis, who was wearing a FedEx uniform and arrived in a FedEx vehicle, physically attacked him in the restroom of the Subway without provocation. 

The complaint includes counts of assault and battery, gross negligence, negligence against both Subway and FedEx entities for failing to ensure safety and proper conduct of their employees or representatives. 

Wargo is seeking compensatory damages for physical injuries sustained during the incident as well as punitive damages.
