A business invitee has filed a lawsuit against a local steak shop and its manager, alleging negligence that led to severe injuries. The complaint was filed by Marvin Bowlers in the Court of Common Pleas of Delaware County, PA, on August 11, 2024, naming Leo’s Steak Shops, Inc., and Steve Mullan as defendants.
According to the court documents, Marvin Bowlers claims that on December 23, 2023, he suffered significant injuries at Leo’s Steak Shop located at 1403 Chester Pike in Folcroft, PA. The incident occurred when an unsecured metal shelf fell on him after another customer attempted to access it. Bowlers alleges that the premises were in a dangerous condition due to the negligence of the defendants. He asserts that Leo’s Steak Shops and its manager failed to inspect and maintain the premises adequately. "The Defendants neglected to periodically inspect, adequately maintain, repair, and/or secure the aforesaid shelf," states the complaint.
Bowlers' injuries include disc herniations of the lumbar spine and right knee injuries requiring treatment with injections. The plaintiff contends that these injuries have caused ongoing physical pain and emotional distress, significantly impacting his daily life and ability to work. Furthermore, Bowlers argues that the defendants had a duty to ensure the safety of their business invitees but failed to do so by not securing hazardous conditions or providing adequate supervision.
The plaintiff is seeking judgment for an amount not exceeding $50,000 plus interest and costs for delay. He requests compensation for medical expenses incurred due to his injuries and anticipates future medical costs as well. Additionally, Bowlers seeks damages for his inability to perform daily chores and occupational duties since the incident.
