The complaint, filed by Isaac Henry Flattau and Anna Flattau in the Delaware County Court of Common Pleas on August 15, 2024, accuses multiple defendants including Sh Opco the Quadrangle LLC and Healthpeak Properties, Inc., of failing to provide adequate care that led to the decline and eventual death of John W. Flattau.
The plaintiffs, Isaac Henry Flattau and Anna Flattau, acting as co-executors of their father’s estate, have filed this lawsuit against several entities involved in the management and operation of the Quadrangle healthcare facility located at 3300 Darby Road, Haverford, PA. According to the complaint, John W. Flattau was admitted to the facility on January 5, 2023, with a diagnosis of nontraumatic intracerebral hemorrhage. During his stay from January to February 2023, he experienced multiple unwitnessed falls that resulted in severe injuries including a subdural hematoma, right rib fracture, transverse lumbar fracture, bruising, and left flank hematoma. These injuries allegedly contributed to his physical decline and subsequent death on March 7, 2023.
The complaint details numerous instances where the defendants allegedly failed in their duty of care. Specific accusations include "failure to sufficiently monitor Plaintiff's decedent for fall prevention," "negligently supervising nursing staff," and "failing to timely identify, diagnose, and treat Plaintiff's decedent’s injuries." Furthermore, it is claimed that there was an overall lack of competent staffing and inadequate training provided to those responsible for patient care. The plaintiffs argue that these failures directly led to John W. Flattau’s deteriorating condition and ultimate demise.
The plaintiffs are seeking judgments against each defendant for amounts exceeding $50,000. They assert claims under both negligence and corporate negligence doctrines. The lawsuit also includes counts for wrongful death under Pennsylvania Judiciary Act 42 Pa.C.S. §8301 and survival action under Pennsylvania Judiciary Act 42 C.S. §8302.
