A grieving family has filed a lawsuit against multiple healthcare entities, alleging gross negligence and substandard care that led to the death of their loved one. On August 14, 2024, Tamika Brown, acting as the administratrix of Earnest Dixon Sr.'s estate, filed a complaint in the Delaware County Court of Common Pleas against Providence Operator LLC, Quinto Holdings LLC, UKR Consulting LLC, Marquis Health Consulting Services LLC, and TRYKO Holdings LLC.
The lawsuit stems from the treatment Earnest Dixon Sr. received while residing at Providence Rehabilitation & Healthcare Center at Mercy Fitzgerald from November 2022 to January 2023. According to the complaint, Dixon was admitted with bilateral heel pressure injuries and subsequently developed additional pressure ulcers due to alleged inadequate care. The plaintiff claims that despite being aware of Dixon's condition and high risk for further injury, the defendants failed to provide necessary medical attention and resources.
"Defendants knowingly established staffing levels that created recklessly high resident-to-staff ratios," reads one part of the complaint. It goes on to accuse the defendants of failing to rotate or reposition Dixon adequately, neglecting proper wound care protocols, and not providing sufficient nutrition. As a result of these alleged failures, Dixon's condition deteriorated significantly during his stay at the facility.
Upon discharge on January 7, 2023, Dixon was documented with severe pressure injuries that had worsened under the facility's care. He passed away on February 27, 2023. The plaintiff argues that these injuries directly contributed to his physical decline and eventual death.
The complaint seeks judgment in excess of $50,000 for each count against each defendant. The lawsuit includes counts of negligence and corporate negligence against all named entities. "Defendants exercised complete and total control over the healthcare of all residents," states another section of the filing.
