A construction worker has filed a lawsuit against multiple entities for severe injuries sustained on the job due to alleged safety violations. The complaint was filed by Sebastian Urgiles-Sanchez in the Court of Common Pleas of Allegheny County, Pennsylvania, on August 14, 2024, naming Dynamic Roofing Solutions, LLC and several unidentified individuals and companies as defendants.
According to the court documents, Urgiles-Sanchez was working on a roofing project at 113 W. Wild Cherry Drive in Mars, PA, on April 5, 2023. The plaintiff alleges that the defendants failed to provide proper fall protection and neglected essential safety measures required by OSHA regulations. As a result of these alleged failures, Urgiles-Sanchez fell approximately thirty feet from the roof onto concrete ground below, suffering multiple fractures and other serious injuries.
The complaint details how Dynamic Roofing Solutions, LLC along with unidentified individuals referred to as John Doe 1 and John Doe 2, and fictitious business entities ABC Company 1 and ABC Company 2 were responsible for overseeing the project’s safety protocols. "Despite knowing or having reason to know of such conditions," states the complaint, "the Defendants failed to take action to eliminate the dangerous conditions and make the jobsite safe." The document further accuses these parties of failing to comply with federal OSHA regulations (29 CFR 1926.501), which mandate adequate fall protection for workers operating at significant heights.
Urgiles-Sanchez claims that due to this negligence he suffered severe internal and external injuries including lumbar spine fracture, multiple thoracic vertebrae fractures, right distal radius fracture with intra-articular involvement, left wrist fracture, bilateral pneumothoraces among others. These injuries have allegedly caused him great pain and agony and will continue to prevent him from performing his daily duties and occupation.
The plaintiff is seeking judgment against all named defendants jointly or severally in an amount exceeding $50,000 plus interest and costs. He also demands a jury trial for this case.
