Plaintiff accuses transit company of negligence after paratransit van accident

A Pennsylvania man is suing a local transit company for negligence after a paratransit van accident left him with severe injuries. Lawrence White filed the complaint in the Court of Common Pleas of Allegheny County, Pennsylvania, on August 13, 2024, against S&S Transit, Inc., and two unidentified individuals referred to as John Does #1-2.

The case centers around an incident that occurred on August 30, 2022. According to the complaint, White was being transported by an S&S Transit van to and from a medical appointment at UPMC Presbyterian Hospital in Pittsburgh. Upon returning home, White alleges that the transit driver instructed him to move towards the lift gate of the van. Unlike previous rides where he was guided safely by the driver, this time he encountered a ramp inside the vehicle that caused his wheelchair to flip backward violently onto the floor of the van.

White's attorney, Daniel F. Ashton of McEldrew Purtell law firm in Philadelphia, asserts that S&S Transit failed in its duty to ensure passenger safety. The complaint lists numerous allegations against S&S Transit and its employees, including failure to supervise their agents properly, inadequate training and hiring practices, and neglecting to provide safe exit procedures for passengers. "The negligence of Defendant, S&S Transit... consisted of failing to properly and adequately supervise their agents... failing to ensure patients were properly and safely able to exit the vehicle," reads part of the complaint.

As a result of this alleged negligence, White claims he suffered serious injuries requiring extensive medical treatment and surgery. He further states that these injuries have led to significant financial losses due to medical expenses and impaired earning capacity. Additionally, White claims ongoing physical pain, emotional distress, and a diminished ability to enjoy life.

White is seeking judgment against S&S Transit and John Does #1-2 for an amount exceeding $50,000 plus interest and costs. He also requests additional relief deemed just by the court, including delay damages pursuant to Pennsylvania Rule of Civil Procedure 238.
