West Virginia Couple Sues Pittsburgh-Based Alco Parking Corp Over Negligence Leading To Severe Injuries

A couple from West Virginia has taken legal action against a prominent Pittsburgh-based parking corporation, alleging negligence that led to severe injuries. Richard Franklin and Kimberly Franklin filed the complaint on August 15, 2024, in the Court of Common Pleas of Allegheny County, Pennsylvania, targeting ALCO Parking Corporation.

According to the lawsuit, Richard Franklin was walking in the Southside Works area on August 16, 2022, when he tripped and fell due to an "extremely uneven and negligently maintained section of concrete sidewalk" on ALCO Parking Corporation's premises. The plaintiffs argue that the corporation had a duty to maintain its property in a reasonably safe condition for lawful visitors like Mr. Franklin. The complaint states that ALCO Parking Corporation failed to fulfill this duty by not maintaining the sidewalks properly and failing to warn visitors about potential hazards.

The lawsuit details several allegations against ALCO Parking Corporation, including failure to maintain and repair the premises adequately, failure to inspect or clean the area properly, and failure to provide sufficient warnings about dangerous conditions. The plaintiffs claim these failures directly resulted in Mr. Franklin's fall and subsequent injuries. "Defendant had specific knowledge of the conditions which caused Plaintiff to fall," reads one part of the complaint.

As a result of his fall, Richard Franklin sustained serious and permanent personal injuries that have caused him great physical pain and emotional distress. The complaint notes that these injuries have led to significant medical expenses and loss of earnings capacity for Mr. Franklin. Furthermore, Kimberly Franklin claims she has been deprived of her husband's companionship and support due to his injuries.

The plaintiffs are seeking judgment against ALCO Parking Corporation in excess of $50,000 for each count listed in their complaint. They demand compensation for medical expenses, lost wages, pain and suffering, emotional distress, and loss of consortium.

Representing the Franklins is attorney John K. Lewis Jr., from Pittsburgh Injury Lawyers P.C., while no defense counsel has been named yet for ALCO Parking Corporation. The case is assigned Case ID NO. GD-24- with proceedings set before Judge (name not provided).
