Former Employee Alleges Disability Discrimination Against Residential Services Provider

A former employee has filed a lawsuit against her previous employer, alleging severe discrimination and retaliation due to her disabilities. Sarah Sullivan lodged the complaint in the United States District Court for the Western District of Pennsylvania on August 15, 2024, accusing Laurel House, Inc. of violating the Americans with Disabilities Act (ADA) and the Pennsylvania Human Relations Act (PHRA).

Sarah Sullivan, who resides in Greensboro, Greene County, PA, worked for Laurel House from April 8, 2013, until her termination on December 13, 2023. Laurel House is a facility providing residential services for developmentally disabled adults. During her tenure as a program specialist at Laurel House, Sullivan claims she was an exemplary employee but faced significant challenges due to her disabilities: Ehlers-Danlos syndrome (EDS), Barrett’s Esophagus (BE), and asthma.

According to the complaint, Sullivan's issues began escalating after she had surgery in September 2021 related to her EDS diagnosis. Despite providing necessary medical documentation for time off work due to surgery complications, she alleges that Dana Zinck, the Director at Laurel House, began harassing her. The harassment included exclusion from daily lunch events and disparaging remarks about her health and attendance to co-workers.

Sullivan's condition required reasonable accommodations which she claims were either ignored or denied by Zinck. For instance, despite having work restrictions due to being at higher risk of contracting COVID-19 and other physical limitations like bending and lifting restrictions supported by doctor's notes, Zinck allegedly forced Sullivan into unsafe working conditions.

The complaint details several incidents where Sullivan was subjected to discriminatory treatment:
- On November 9, 2021, during a safety committee training via Zoom at the office when she felt extremely sick and needed medical attention.
- In January 2022 when she was made to work inside a group home amid a COVID outbreak.
- Regular scrutiny over minor illnesses requiring time off while similarly situated employees without disabilities were not subjected to such treatment.

Despite raising these issues with Joel Triponey, the Human Resources Agent since May 2023, no corrective actions were taken. Instead of addressing her concerns about discrimination and harassment adequately, Triponey suggested that Sullivan might want to resign if she found the work environment too toxic.

The situation culminated in October 2023 when Sullivan had an asthma attack triggered by a coworker burning scented wax in a candle warmer. After taking medically advised leave for recovery and informing her supervisors with proper documentation from MedExpress physicians advising rest until October 23rd; upon return she faced unwarranted disciplinary action bypassing usual progressive discipline steps straight into final warning.

In December 2023 after posting about workplace anxiety on Facebook seeking emotional support from friends without mentioning specific names or details about Laurel House itself - this led directly towards suspension followed quickly by termination under pretextual reasons stated as violation of company’s code-of-conduct/social-media policies which according plaintiff were retaliatory actions against exercising protected rights under ADA & PHRA laws including filing complaints with Department Of Labor (DOL) & Equal Employment Opportunity Commission (EEOC).
