Local Resident Sues Pat’s Pizza & Pasta Over Negligence Leading To Severe Injuries

A local resident has filed a lawsuit against a well-known pizzeria, alleging negligence that led to severe injuries. Thomas Budd filed the complaint in the Court of Common Pleas in Delaware County on August 21, 2024, naming Pat’s Pizza & Pasta, LLC, Pat’s Pizzaria Nasos, Inc., Athanasios Belitsas, and several unidentified individuals as defendants.

According to the court documents, Budd claims that on March 5, 2023, he visited Pat’s Pizza & Pasta located at 2900 Township Line Road in Drexel Hill. While walking into the restroom around 7:15 p.m., he slipped and fell due to water on the floor caused by an overflowing toilet. The plaintiff alleges that this hazardous condition was a result of the defendants' failure to maintain safe premises. "The defendants knew or should have known of the existence of the hazardous and dangerous condition," states the complaint.

Budd's legal representation argues that the defendants were negligent in multiple ways: failing to maintain safe conditions on their premises, not inspecting for potential hazards, neglecting to warn patrons about existing dangers, and inadequately maintaining plumbing systems. The complaint further accuses them of failing to repair known issues and improperly supervising maintenance personnel. These actions allegedly led to Budd sustaining severe injuries including damage to his neck, shoulder, back, hip, leg, and ankle. He also suffered from severe shock and nervous system trauma.

The plaintiff asserts that these injuries have had a profound impact on his life. He claims he has been unable to perform his usual duties and activities since the incident and may continue to face these limitations in the future. Additionally, Budd anticipates incurring substantial medical expenses for ongoing treatment and care related to his injuries. "As a further result of the aforesaid accident and resultant injuries," reads the complaint, "plaintiff has been caused to undergo in the past and is likely to undergo in the future severe pain, suffering, inconvenience and embarrassment."

Budd is seeking judgment against all named defendants for an amount exceeding both arbitration limits and Federal Court jurisdictional limits for diversity jurisdiction cases. His attorney Christopher R. Durso from Rosenbaum & Associates is representing him in this case.
