Plaintiff alleges local official violated property rights

A widow is seeking justice for her late husband's property rights, alleging abuses of power by a local official. Janet Helbling filed a complaint in the United States District Court for the Western District of Pennsylvania on August 21, 2024, against Robert Pebbles Jr. and Liberty Township.

The case revolves around John D. Helbling's property at 2892 Mercer Butler Pike, Grove City, which he purchased in 2000. Initially in dilapidated condition, Mr. Helbling aimed to remodel it into apartments for students from nearby colleges. However, disputes with Pebbles, who claimed to be the township inspector, allegedly obstructed these plans. Pebbles demanded detailed architectural plans and a septic system installation and even ordered unnecessary environmental investigations. He also arbitrarily stopped work on several occasions.

In early 2023, while Mr. Helbling was hospitalized, Pebbles verbally ordered the demolition of the partially renovated building within thirty days or face substantial fines. Under duress and fearing hefty penalties, Mr. Helbling complied but incurred significant costs due to emergency rates charged by his contractor G&J Waterproofing Inc.

Janet Helbling claims that these actions caused her husband great mental distress and contributed to his deteriorating health and eventual death on December 29, 2023. She accuses Pebbles of violating constitutional rights under the Fifth and Fourteenth Amendments by depriving her husband of his property without due process or lawful justification.

The plaintiff seeks compensatory damages for financial losses incurred due to coerced demolitions and unnecessary work orders issued by Pebbles. Additionally, she demands punitive damages for emotional distress suffered by her late husband and attorney fees under 42 U.S.C §1988.
