A resident of Sharon Hill, Pennsylvania, has filed a lawsuit alleging severe negligence against multiple entities responsible for maintaining local infrastructure. Melinda Evans initiated the complaint on August 13, 2024, in the Delaware County Court of Common Pleas against Sharon Hill Commons and several other defendants.
According to the complaint, Evans was walking near Sharon Avenue and Woodland Avenue on June 25, 2023, when she tripped over an uncovered utility hole. The incident occurred around 8:30 p.m., resulting in serious injuries to her neck, back, and foot. Evans claims that the hazardous condition was due to the negligence of the defendants who failed to maintain the street and utility hole properly. The plaintiff argues that these entities had a duty to ensure the safety of pedestrians but neglected this responsibility.
The lawsuit names multiple defendants including Sharon Hill Commons, LP; Sharon Hill Development Corporation; Aqua Pennsylvania, Inc.; Pennsylvania Public Utility Commission; The Community Action Agency of Delaware County, Inc.; Borough of Sharon Hill; and several unidentified individuals or entities referred to as John Does I-VI. Each defendant is accused of failing to inspect and repair the defective condition or warn pedestrians about it. "Failing to maintain said street and utility hole in a safe and reasonable condition for persons such as the plaintiff using said street," reads one part of the complaint.
Evans is seeking damages exceeding both arbitration limits and Federal Court jurisdictional limits for cases based on diversity jurisdiction. She alleges that her injuries are permanent and have significantly impacted her ability to perform daily activities and work duties. Additionally, she anticipates incurring substantial medical expenses for ongoing treatment related to her injuries.
