Plaintiff sues Dairy Cottage for Negligence Over Dangerous Walkway

A recent court filing reveals a compelling case of alleged negligence involving a local business and its property. On September 16, 2024, Michael Vecchione filed a complaint in the Court of Common Pleas of Delaware County, Pennsylvania, against Dairy Cottage and several associated entities and individuals.

The lawsuit centers around an incident that occurred on March 18, 2023. According to the complaint, Vecchione was walking on the premises of Dairy Cottage located at 328 W. Woodland Avenue in Springfield, PA when he tripped over an uneven walkway. The fall resulted in severe injuries that Vecchione claims were due to the defendants' failure to maintain safe conditions on their property. The named defendants include Dairy Cottage, 328 West Woodland LLC, Perry A. Higgins, ABC Corporations 1-10, and John Doe(s) 1-10.

Vecchione's attorney, Ashley E. Killeen from KaplunMarx PLLC, argues that the defendants had a duty to ensure the safety of their premises but failed to do so. "The area where Plaintiff fell was caused, permitted, and allowed by All Defendants to become and remain a highly dangerous condition," reads the complaint. It further alleges that the defendants neglected essential maintenance tasks such as inspecting and repairing walkways and failed to warn visitors about potential hazards.

Vecchione is seeking judgment for damages exceeding $50,000. He claims his injuries have led to significant physical pain, mental anguish, loss of life's pleasures, medical expenses, wage losses, and other financial burdens. The plaintiff also asserts that these injuries are permanent in nature.
