In a legal battle that could set a precedent for utility companies, Duquesne Light Company has filed a lawsuit against an individual, alleging negligence and seeking compensation for damages to its property. The complaint was filed on October 16, 2024, in the Court of Common Pleas of Allegheny County, Pennsylvania, with Rotasia Haymon named as the defendant.
According to the complaint, Duquesne Light Company, a Pennsylvania-based electricity service provider headquartered at 411 Seventh Avenue in Pittsburgh, accuses Rotasia Haymon of causing damage to its utility pole and electric facilities. The incident reportedly occurred on December 13, 2022, when Haymon was operating a Jeep Grand Cherokee near 600 Hazelwood Avenue in Allegheny County. The company claims that Haymon's negligent operation of her vehicle led to a collision with their property.
The complaint outlines several allegations against Haymon. It asserts that she failed to maintain proper control of her vehicle and did not keep a lookout while driving. Additionally, it is alleged that she drove carelessly and at an unsafe speed. Other accusations include operating the vehicle without insurance or a valid driver's license and potentially being under the influence of alcohol or other substances at the time of the incident. These actions are said to have breached her duty of care and directly resulted in damages amounting to $5,546.32 for repairs undertaken by Duquesne Light Company.
Duquesne Light is seeking judgment against Haymon for the stated amount along with interest and costs associated with the legal proceedings. They argue that their repair work was conducted in a reasonable manner and are pursuing any additional relief deemed appropriate by the court.
Representing Duquesne Light Company is attorney Lauren N. Rulli from Pittsburgh. The case is identified under Case No: CVPDD008S219F457- in the Civil Division-Arbitration section of the Court of Common Pleas of Allegheny County.
