The Delaware County Court of Common Pleas reported the following activities in the suit brought by Pabian Properties against Melody Starling on Jan. 24.

'The Court Is In Receipt Of An Appeal Request Regarding The Above-captioned Matter Filed On January 23, 2024. The Decision Of The Court Below Was Issued On Friday, January 5, 2024 – Meaning That The 5-day Appeal Period Prescribed By 25 Del. Code § 5717 Would Have Expired At The Close Of Business On January 12, 2024. The Record Does Reflect That The Defendant Made An Attempt To Appeal On The First Day Possible – January 8, 2024. However, As A Result Of Court Error, Incorrect Documentation Was Provided For The Purpose Of Appeal. It Was Only After The Appeal Period Had Expired That The Error Was Recognized. On That Basis, The Court Hereby Deemed That The Court’s Own Error Tolled The Appeal Time-Frame And Will Accept The Appeal Request As Timely For Its Purpose.'
