India Linder filed a complaint on January 7, 2023, in the Court of Common Pleas of Delaware County against Darrell Coleman, alleging negligence and strict liability after being attacked by Coleman's dog.
According to the complaint, India Linder was visiting Darrell Coleman's residence at 1301 Manor Road in Yeadon, Pennsylvania when she was suddenly attacked by a 140-pound bullmastiff owned by Coleman. The lawsuit claims that Coleman failed to properly restrain his dog despite being aware of its vicious tendencies. As a result of this alleged negligence, Linder suffered severe injuries including scarring and trauma to her wrists, shoulders, and forearms. The complaint highlights that these injuries have left her scarred, sore, disabled, and suffering from ongoing physical pain and mental anguish.
The plaintiff's attorney, Omid Niknam from the Law Offices of Omid Niknam P.C., argues that Coleman breached his duty to ensure the safety of visitors on his property by not controlling his dangerous pet. "At all times material hereto," states the complaint, "Defendant Coleman had actual and/or constructive knowledge of the vicious propensity of his dog and failed to remedy same." Linder is seeking damages not exceeding $50,000 for medical expenses incurred due to the attack and anticipated future costs related to her recovery.
