Chubb National Insurance Company has filed a lawsuit in the Delaware County Court of Common Pleas against two individuals, Sara Alston-Edwards and Davire Gonzalez Thomas, for damages arising from a motor vehicle accident. The complaint was filed on January 7, 2025, by Chubb National Insurance Co., representing Grace and Nicholas Giovanangelo, who are the insured parties affected by the incident.
The case revolves around an accident that occurred on January 22, 2023. According to the complaint, a vehicle owned by Sara Alston-Edwards and operated by Davire Gonzalez Thomas collided with a car insured by Chubb National Insurance at N. Middletown Road and Barren Road in Middletown Township, Pennsylvania. The plaintiff alleges that the defendants were negligent and careless in their operation of the vehicle, which led to significant property damage and other expenses for the Giovanangelos.
The complaint outlines several specific allegations of negligence against Alston-Edwards and Gonzalez Thomas. These include failing to maintain a proper lookout, not yielding the right of way, not keeping an assured clear distance, disobeying traffic rules, driving at an unreasonable speed under the circumstances, improper brake application, failing to maintain control of their vehicle, and negligently entrusting their vehicle to someone deemed incompetent to drive. As a result of these alleged failures, Chubb National Insurance claims it had to cover $9,942.81 in property damages and $2,847.56 in rental expenses for its insureds.
Chubb is seeking a judgment against both defendants jointly and severally for a total amount of $12,790.37 plus interest and costs associated with the lawsuit. This amount represents compensation for both property damage and rental expenses incurred due to the accident.
