Florence Trinsey and her husband, Henry Trinsey, have filed a lawsuit against PJW Restaurant Group, alleging negligence that led to severe personal injuries. The complaint was filed on January 8, 2025, in the Court of Common Pleas of Delaware County, Pennsylvania. The defendants include PJW Restaurant Group and P.J. Whelihan’s Pub & Restaurant.
The case centers around an incident that occurred on January 21, 2023, at approximately 5:00 p.m., when Florence Trinsey visited P.J. Whelihan’s Pub & Restaurant located at 853 East Lancaster Avenue in Downingtown, Pennsylvania. According to the complaint, while attempting to sit down after obtaining food from a buffet table, the chair collapsed unexpectedly. This caused Florence to fall backward and sustain serious injuries to her head and neck. The plaintiffs allege that the restaurant failed in its duty to maintain safe premises for its patrons.
The lawsuit claims that PJW Restaurant Group was negligent in several ways: failing to inspect and maintain the safety of their furniture, not providing adequate warnings about potential hazards, and allowing dangerous conditions to persist on their property. "Defendants negligently permitted the aforesaid property and/or chair to become and remain in a dangerous condition," states the complaint. Furthermore, it accuses the restaurant of violating standard care owed to business invitees by allowing them to use defective furniture.
Florence Trinsey seeks compensation for her injuries which she claims are permanent and have caused significant pain and suffering. She is requesting damages less than $50,000 along with costs of suit and interest as allowed by law. Her husband Henry is also seeking damages for loss of consortium due to his wife's injuries affecting their marital relationship.
