The case revolves around an incident that occurred on May 11, 2024, at approximately 11:00 p.m. when Hayes was a patron at Ram’s Pizza Tavern, operated by DJ’s on Broadway Inc. According to the complaint, one of the employees negligently dropped burning coals from a hookah onto Hayes, resulting in severe injuries to her back and fingers. Hayes claims these injuries have caused her significant physical pain and mental anguish and may be permanent. She also asserts that she has incurred substantial medical expenses and has been unable to perform her usual daily duties since the incident.
Hayes accuses DJ’s on Broadway Inc. of several counts of negligence. These include failing to secure the hookah properly, inadequately training their staff on handling such equipment safely, and not taking necessary precautions to protect business invitees from foreseeable risks. The complaint highlights that these failures were direct causes of Hayes' injuries and subsequent losses.
