Property Owners Accused of Negligence After Tenant Injury at Pennsylvania Apartment Complex

Kira Daniels and Oscar Green have filed a lawsuit that could shake up property management practices in Pennsylvania. The couple alleges negligence against two property management companies, claiming serious injuries resulted from poorly maintained premises. This complaint was filed by their attorney, Vincent A. Guarna, on February 5, 2025, in the Court of Common Pleas of Delaware County against Aguntum Associates LP and Westover Property Management Company LP.

The plaintiffs, Kira Daniels and Oscar Green, are seeking justice after an incident on March 21, 2023, at the Rolling Glen Apartments and Townhouses in Boothwyn, Pennsylvania. According to the complaint, Kira Daniels was lawfully pushing her father's wheelchair when she encountered a hazardous condition on the walkway leading from Building 11 to the rear parking lot. The uneven transition between the landing area and parking lot allegedly caused her to slip and fall, resulting in severe injuries including a fractured patella and lumbar strain. "Defendants had knowledge and notice of said defective defect prior to or at the time of the incident accident," states the complaint.

The lawsuit accuses Aguntum Associates LP and Westover Property Management Company LP of failing to maintain safe premises. It details multiple counts of negligence such as not inspecting or repairing dangerous conditions on their property, failing to warn visitors about potential hazards, and violating local statutes regarding pavement maintenance. The plaintiffs argue that these oversights directly led to Kira's injuries which have left her with ongoing pain and suffering as well as mental anguish.

In addition to compensation for medical expenses exceeding $50,000 incurred due to Kira's injuries, Oscar Green is also seeking damages for loss of companionship and consortium with his wife following her accident. The couple demands judgment against both defendants jointly for amounts surpassing $50,000 plus costs associated with this legal action.
