Plaintiff Alleges Former Creditor Violated Debt Collection Laws

Daniel Negron, a resident of Philadelphia, has filed a lawsuit against Westlake Services, LLC, accusing the company of violating multiple consumer protection laws. The complaint was lodged in the Court of Common Pleas of Allegheny County, Pennsylvania, on February 28, 2025. Negron claims that Westlake Services wrongfully reported a debt on his credit report despite a prior court judgment in his favor.

However, by February 3, 2021, the Philadelphia Municipal Court had ruled in favor of Negron regarding this debt. Despite this ruling, Negron discovered in May 2023 that the debt was still being reported on his credit report. According to the complaint filed by Negron's attorney John T. "Defendant reported a debt to the credit reporting agencies that Plaintiff legally did not owe," reads one accusation in the complaint.

Negron's lawsuit accuses Westlake Services of violating several statutes including the Fair Debt Collection Practices Act (FDCPA), Fair Credit Extension Uniformity Act (FCEUA), Unfair Trade Practices and Consumer Protection Law (UTPCPL), and Fair Credit Reporting Act (FCRA). Specifically, he alleges that Westlake Services failed to update or correct information with credit agencies even after being informed about the dispute over the alleged debt. The complaint argues that these actions constitute unfair and deceptive practices under both state and federal law.

Negron is seeking various forms of relief from the court. He requests compensatory damages for emotional distress caused by these alleged violations as well as statutory damages under FDCPA provisions. Additionally, he seeks treble damages under FCEUA and UTPCPL for what he describes as fraudulent or deceptive conduct by Westlake Services.
