William Kinder, through his Power of Attorney Antoinette Derrickson, has filed a lawsuit against Adibah Kinder in the Delaware County Court of Common Pleas on February 26, 2025. The complaint accuses Adibah Kinder of fraudulently acquiring ownership of a property located at 1125 Kerlin Street, Chester, PA, which belongs to William and Florence Kinder.
The legal dispute centers around an alleged fraudulent transaction involving a quitclaim deed executed on February 16, 2024. According to the complaint, during a meeting with William and Florence Kinder—both diagnosed with dementia—Adibah Kinder coerced them into signing a quitclaim deed that transferred their property to her for merely one dollar. This transaction was based on misleading representations that the deed would only take effect after their passing and was purportedly a strategy to avoid inheritance taxes while maintaining ownership during their lifetime. The plaintiffs claim they did not understand these representations nor intended to gift the property.
On July 16, 2024, Adibah recorded this deed without providing any consideration or obtaining proper consent from the Kinders. Upon discovering this action in September 2024, William Kinder's counsel demanded the property's return. Although Adibah initially agreed to transfer back the property during a conversation facilitated by the Delaware County Office of Services for the Aging, she later refused to execute the necessary documents.
The plaintiff is seeking several forms of relief from the court. They request that the court quiets title in favor of William and Florence Kinder, effectively nullifying Adibah's claim over the property. Additionally, they seek compensatory damages exceeding $50,000 for unjust enrichment and fraud due to Adibah's actions that deprived them of their rightful ownership without just compensation. The complaint also demands punitive damages for conversion as Adibah allegedly deprived them of their rights without lawful justification.
