A Delaware County resident has taken legal action against her former landlord, accusing them of negligence that resulted in severe health issues. Charlene Johnson filed a complaint in the Court of Common Pleas of Delaware County on February 28, 2025, against Brenda Savage, alleging dangerous living conditions at her rented apartment.
According to the court documents, Johnson leased an apartment from Savage located at 1043 Townsend Street, Chester, Pennsylvania. The plaintiff claims that she repeatedly notified Savage about defective heating systems and appliances that posed significant health risks. Despite these complaints, no repairs were made. On May 9, 2024, an inspection by the Chester Township Fire Company and PECO revealed that carbon monoxide was leaking into the apartment due to a faulty gas line and oven appliance. Additionally, mold was discovered in the basement. These hazardous conditions allegedly led to Johnson experiencing symptoms such as dizziness and lightheadedness.
Johnson asserts that Savage's failure to address these issues constituted negligence and resulted in serious injuries including carbon monoxide poisoning and lung embolism. She accuses Savage of not maintaining a safe environment for tenants by neglecting necessary inspections and repairs despite being aware of the hazards. The complaint outlines several instances of alleged negligence: failing to maintain the premises properly, allowing defects to persist after notification, and violating safety codes as a landlord.
The plaintiff is seeking damages exceeding $50,000 for medical expenses incurred due to her injuries as well as compensation for ongoing physical pain and mental anguish. Johnson also requests additional costs related to interest, delay damages, and attorney fees under Pennsylvania law.
