A local resident has taken legal action against a well-known supermarket chain and its property management company following an alleged slip-and-fall incident. Daniel Peticca filed a complaint in the Court of Common Pleas, Delaware County, Pennsylvania, on February 24, 2025, against Acme Markets Inc. and Madison-RTL Clifton Heights PA LLC. The lawsuit claims negligence on the part of the defendants led to Peticca's injuries.
According to the complaint, Daniel Peticca was shopping at an Acme Market located at 5300 W. Baltimore Pike in Clifton Heights when he slipped on liquid that had accumulated near freezer or refrigeration equipment. The incident occurred on September 10, 2023, around 10:30 p.m., while Peticca was legally present as a business invitee. The complaint alleges that the equipment had been leaking for some time before his fall and that employees of Acme Markets were aware of this issue but failed to address it adequately.
Petitioner's attorney, Jacqueline Morgan from Lowenthal & Abrams, P.C., outlined several points of negligence in the complaint. These include failure to maintain safe premises by not repairing or cleaning areas where invitees are likely to travel and not providing adequate warnings about known hazards such as leaking equipment. Furthermore, it is claimed that Acme Markets' staff admitted knowledge of the leak prior to Peticca's fall and had reported it according to company protocol.
The lawsuit asserts that both Acme Markets Inc. and Madison-RTL Clifton Heights PA LLC neglected their duty to ensure a safe environment for customers by failing to fix or barricade the dangerous area or provide sufficient warning about potential risks. As a result of these alleged failures, Peticca suffered multiple injuries including cervical strain, right elbow contusion, lumbosacral strain, and lumbar herniation with intermittent radiculopathy.
Petitioner seeks compensation exceeding $50,000 for medical expenses incurred due to treatments required after the incident as well as economic losses related to ongoing medical care needs. Additionally sought are damages for physical pain endured since then along with emotional distress caused by bodily impairment affecting daily activities enjoyment levels significantly diminished post-incident.
