Marie Troisi, a resident of Media, Pennsylvania, has filed a civil lawsuit against Fulton Bank and several other defendants following an alleged incident that left her with severe injuries. The complaint was filed on February 19, 2025, in the Court of Common Pleas of Delaware County, targeting Fulton Bank along with Stuart Klein, Jamie Klein, Media Borough, and two unidentified entities referred to as John Doe Paving Company and John Doe Contractor.
The lawsuit stems from an incident that occurred on March 18, 2023. According to the complaint, Marie Troisi was walking on the sidewalk at 448 E Baltimore Avenue in Media when she tripped over a slope that had been present for some time. Troisi alleges that the defendants failed to maintain the sidewalk properly and did not take necessary precautions to warn pedestrians about the hazardous condition. The plaintiff asserts that "Defendants knew or should have known" about the dangerous slope and had ample time to rectify it. As a result of this negligence, Troisi claims she suffered "serious and permanent injuries," including damage to her neck, back, shoulders, chest, head, knees, body, and extremities.
Troisi's legal team argues that the defendants were negligent in various ways: failing to repair the defective condition of the sidewalk; neglecting to inspect the property thoroughly; not posting warning signs or notices; allowing hazardous conditions to persist; and violating local ordinances related to property maintenance. These actions allegedly led to Troisi's fall and subsequent injuries. The plaintiff further contends that these injuries have caused her significant physical pain and emotional distress. She also anticipates ongoing medical expenses due to treatments necessitated by her injuries.
In addition to seeking compensatory damages not exceeding $50,000 for her physical injuries and associated costs such as medical bills and loss of earnings capacity, Marie Troisi is asking for reimbursement of legal fees incurred during this process. Her complaint emphasizes how this incident has disrupted her daily life significantly—preventing her from performing routine chores or fulfilling occupational duties—and has financially impacted both herself and her family.
Representing Marie Troisi is attorney Joel J. Kofsky from The Law Office of Joel J. Kofsky based in Philadelphia. This case will be heard under arbitration guidelines within Delaware County’s judicial system during its February term session. The case ID is: CV2025001831.
