Ayana Gettysmith has filed a compelling lawsuit against Albert and Agnes Saveri, alleging negligence in a dog attack incident that left her with severe injuries. The complaint was officially lodged on March 5, 2025, in the Delaware County Court of Common Pleas against Albert Saveri and others.
According to the court documents, Gettysmith, a resident of Philadelphia, was delivering a package at the Saveris' residence on June 25, 2024, when she was unexpectedly chased by their dog. The incident occurred at approximately 6:15 p.m. at 16 Clearbrook Road in Newtown Square, Pennsylvania. The complaint details how the plaintiff fell to the ground as she attempted to escape from the dog, resulting in significant injuries to her shoulder, elbow, knee, and hand. Gettysmith's attorney asserts that these injuries have not only caused physical pain but have also impacted her ability to perform daily activities and fulfill her vocational duties.
The legal action points out several instances of alleged negligence on the part of the defendants. It claims that Albert and Agnes Saveri failed to control or properly train their dog despite being aware of its vicious tendencies. "Defendants knew or should have known of their dog's dangerous and/or vicious propensities," states the complaint. Furthermore, it accuses them of neglecting to warn visitors about the dog's aggressive nature and failing to secure it adequately within their premises.
In addition to Albert and Agnes Saveri, the lawsuit names fictitious parties—John Does I-III and John Does IV-VI—who are believed to be individuals or entities associated with owning or controlling either the property or the dog involved in this case. The plaintiff invokes the doctrine of Respondeat Superior, suggesting that any agents or employees acting on behalf of these defendants were also negligent.
Gettysmith is seeking both compensatory and punitive damages exceeding arbitration limits for her injuries and losses. She claims ongoing pain and suffering as well as financial burdens due to medical expenses incurred from treating her injuries. Her attorney argues that some injuries may be permanent and could continue affecting her quality of life.
