A Pennsylvania couple has taken legal action against a well-known fitness chain, claiming negligence after a traumatic incident at one of its facilities. On March 14, 2025, Cyrina Nduka filed a complaint in the Court of Common Pleas of Delaware County against Fitness International, LLC, operating as LA Fitness, following an injury she sustained at their Broomall location.

The lawsuit alleges that on April 28, 2023, while using the sauna at the LA Fitness facility located at 2170 West Chester Pike in Broomall, Pennsylvania, Cyrina Nduka suffered serious injuries when her head struck a protruding nail. The complaint details how this unmarked hazard caused her to sustain significant injuries including lacerations and contusions. The plaintiffs assert that both LA Fitness and Marple Associates LP, the property owner where the gym is located, failed in their duty to maintain safe premises for patrons. According to the filing by attorney Richard B. Bateman Jr., "Defendant created the dangerous condition and carelessly, negligently and recklessly failed to maintain and inspect the subject property in proper condition."

Cyrina Nduka's claims are rooted in premises liability law. She accuses both defendants of failing to conduct regular inspections and repairs necessary to ensure safety. The lawsuit argues that LA Fitness neglected its responsibility as operators of the gymnasium by not addressing or warning about the dangerous condition posed by the protruding nail. Similarly, Marple Associates is accused of not fulfilling its duty as property owners to keep the premises safe for public use.

The plaintiffs are seeking damages exceeding $50,000 from each defendant for personal injuries sustained by Cyrina Nduka due to alleged negligence. Additionally, Christian Nduka has filed a claim for loss of consortium against both defendants, citing deprivation of his wife's companionship and financial support resulting from her injuries.
