The complaint was lodged by David McCulloch on March 13, 2025, in the Court of Common Pleas of Delaware County against Barnaby's Aston, Inc., Barnaby's Pennell, Inc., and an individual named Tyler Jensen.
David McCulloch's lawsuit paints a vivid picture of the events leading up to his injuries at a Christmas party held on December 21, 2023. According to the complaint, McCulloch attended the party at Barnaby’s Restaurant & Pub in Media, PA. During this event, it is alleged that Tyler Jensen was served excessive amounts of alcohol by Barnaby’s staff despite being visibly intoxicated. The lawsuit claims that Jensen consumed approximately fourteen alcoholic beverages over four hours and subsequently engaged in reckless behavior that resulted in McCulloch suffering significant injuries.
The plaintiff accuses Barnaby’s of violating Pennsylvania’s Liquor Code by serving alcohol to an intoxicated person and failing to ensure the safety of its patrons. "Defendant BARNABY’S owed a duty to the Plaintiff to ensure that alcohol was served responsibly," reads the complaint. Furthermore, McCulloch alleges negligent security practices on the part of Barnaby’s for not intervening when Jensen began engaging in physical horseplay with other guests.
McCulloch seeks judgment against both Barnaby’s and Jensen for damages exceeding $50,000 each. He demands compensation for medical expenses due to multiple surgeries and rehabilitation resulting from injuries described as ruptures and strains of his quadriceps among other physical traumas. The plaintiff also claims impairment of earning capacity and loss of life's pleasures due to prolonged mobility issues stemming from the incident.
