Gun owner's case against Stroud Township remanded back to trial court
HARRISBURG – The Commonwealth Court of Pennsylvania remanded a case back to trial court involving a Stroud Township gun owner who challenged the constitutionality of not being allowed to discharge firearms on his property due to a local ordinance.
Superior Court affirms preliminary injunction ruling to Tyco Fire Products against former employee
HARRISBURG – The Superior Court of Pennsylvania on Nov. 17 affirmed a trial court decision granting a preliminary injunction to Tyco International Management Co. LLC and Tyco Fire Products LP in a dispute with a former employee whom Tyco officials accused of violating employment contracts after taking a job with a competing company.
Commonwealth Court upholds denial of former Kinder Morgan worker's benefits claim
HARRISBURG – The Commonwealth Court of Pennsylvania ruled that the Workers’ Compensation Appeal Board was right to deny workers’ compensation benefits to a former Kinder Morgan Inc. based on its application of the “mental-mental” standard to the claimant’s mental disability claim, according to an opinion filed Nov. 14 by the Commonwealth Court.
Award of unemployment benefits to terminated Philadelphia Fresh Foods employee upheld by court
HARRISBURG – Philadelphia Fresh Foods LLC’s petition for review of an Unemployment Compensation Board of Review order granting unemployment compensation benefits to a former company employee was unsuccessful, according to a Nov. 14 Commonwealth Court of Pennsylvania opinion upholding the board’s decision.
Superior Court of Pennsylvania derails $597,000 judgment against railway companies
HARRISBURG – The Superior Court of Pennsylvania has overturned a $597,000 judgment against American Premier Underwriters Inc., Consolidated Rail Corp., CSX Transportation, et al. and returned the case back to the lower court for further proceedings because of the actions of the appellee's counsel.
