A Philadelphia man who claims he was injured after a mishap at a grocery store is suing the supermarket store and its parent company.
Attorneys Murray L. Greenfield and Michael F. McCartin, of the Philadelphia law firm of Murray L. Greenfield & Associates, filed the premises liability lawsuit May 17 in the Philadelphia Court of Common Pleas on behalf of Michael Straughn.
The defendants named in the civil suit are Albertson’s Inc., doing business as Acme Markets; Supervalu Inc., doing business as Supervalu Stores Inc. and Acme Markets; and Acme Markets Inc.
In his complaint, Straughn alleges that while working as a merchandiser for Canada Dry of Delaware Valley back in November 2009, he was seriously injured when an Acme employee at the store he was delivering to, located at 6601 Roosevelt Boulevard, who was pulling a jack with empty skids on it hit a pallet that contained 10-foot high stacked soda bottles sending Straughn to the ground.
The incident caused the plaintiff to suffer a disc tear, a disc herniation, depression and anxiety and other physical injuries, which, the lawsuit states, are or may be permanent in nature.
The complaint says Straughn has had to expend various sums of money for medicine and medical attention and other assistance in treating or curing his injuries.
Furthermore, the suit alleges, Straughn has suffered a loss of earning power and capacity, and has incurred a worker’s compensation lien in the amount of $73,736.25.
Straughn is seeking separate judgments against each of the defendants in an amount in excess of $50,000 plus court costs and interests.
A jury trial has been demanded.
