Walgreen chain faces personal injury suit in case of broken wrist

A Bucks County woman who was injured at a local drug store is suing the chain in civil court.

Attorney Stephen David, of the Trevose, Pa.-based law firm of Lamm Rubenstone LLC, filed the personal injury complaint June 9 at the Philadelphia Court of Common Pleas on behalf of Trevose resident Denise Burnett.

The defendant in the lawsuit is the Illinois-based Walgreen Company, Inc.

According to the complaint, Burnett was shopping at the Walgreen store at 2 E. Street Road in Feasterville in late September 2009 at about 10 in the morning when she was injured while exiting the ladies restroom.

The lawsuit claims that a defective bathroom door, without warning, slammed shut on the plaintiff’s left wrist, causing her to sustain a fracture, pain and weakness, traumatic arthritis, a severe shock to her nervous system and other unspecified injuries.

The lawsuit alleges that Burnett, because of the accident, has been caused to expend various sums of money on medical expenses, and that she has experienced a loss in earnings. She has also been prevented from carrying out her daily duties and activities.

The lawsuit accuses the defendant of negligence in failing to inspect the bathroom door for defects, failing to discover the danger, failing to provide warning to customers of the door’s condition, and failing to conform to building and safety codes.

Burnett seeks a judgment against the defendant in an amount in excess of $50,000, along with court costs and related fees.

A jury trial has been demanded. The case awaits listing.
