A Philadelphia couple is suing the Community College of Philadelphia for injuries the wife sustained after falling on a piece of defective sidewalk at the higher learning institution.
Attorney Stephen Hurvitz, of the Philadelphia law firm Stephen C. Hurvitz & Associates, filed the premises liability lawsuit June 9 at the Philadelphia Court of Common Pleas on behalf of Theresa and Wayne Feenan.
According to the civil complaint, Theresa Feenan was at the school’s campus, located at 1700 Spring Garden St., in early September 2009, when she tripped over and fell upon the broken sidewalk, causing her to sustain various injuries.
The suit accuses the college of negligence and recklessness in failing to ensure that the sidewalk was safe for public access.
As a result of the incident, Theresa Feenan suffered left foot and ankle injuries of an unspecified nature, which prevented her from carrying out her daily duties and activities, the lawsuit states.
Furthermore, Feenan has racked up numerous medical bills, which, according to the lawsuit, total somewhere in the range of $10,000 or more, although some of the doctor’s bills listed don’t contain dollar amounts.
As a result of the accident, Theresa Feenan has also suffered a loss of earnings, and may continue to suffer a loss of earning capacity into the future.
Theresa Feenan seeks a judgment in her favor in an amount in excess of $50,000, plus related costs and interest.
In his own count in the lawsuit, husband Wayne Feenan claims that because of his wife’s accident, he has and will continue to suffer “the loss of sex, services and companionship of his wife … to his great detriment and loss.”
In his count, Wayne Feenan also seeks a judgment against the defendant in an amount in excess of $50,000, plus related costs and interest.
A jury trial has been demanded. The case awaits listing.
