Pa. woman files Yaz mass tort lawsuit

Another individual claim has been filed in the Yaz/Yasmin/Ocella mass tort docket at the Philadelphia Court of Common Pleas.

The short-form complaint, filed June 20 by Philadelphia attorney Churchill H. Huston, of The Maher Law Firm, alleges that plaintiff Holly Fuller, of Cochranville, Pa., sustained physical injuries after having ingested the birth control drug Yasmin from about February 2008 to August 2008, and the similar drug Ocella from approximately August 2008 until December 2009.

The complaint states that the married 26-year-old was prescribed the drug by a Coatesville, Pa. doctor.

According to the complaint, Fuller suffered a stroke in late December 2009. She is attributing the condition to side effects from the drug.

The plaintiff accuses the defendants in the suit of fraudulent concealment, strict liability, breach of implied warranty of merchantability, breach of implied warranty of fitness for a particular purpose, negligent failure to warn, negligence, negligent misrepresentation, breach of express warranty and fraud.

Named as defendants are Bayer Coroporation, Bayer Healthcare, LLC, Bayer Pharmaceuticals Corporation, Bayer Healthcare Pharmaceuticals, Inc., Bayer Schering Pharma AG, Teva Pharmaceuticals USA, and Barr Laboratories, Inc.

Fuller prays for relief as set forth in the master long form Yaz complaint.

The plaintiff has demanded a jury trial.
