New Jersey woman sues makers of Yaz

A Cherry Hill, N.J. woman has filed a mass tort complaint against the makers of the Yaz birth control pill for injuries she allegedly suffered as a result of the product’s use.

Philadelphia lawyer Scott D. Levensten, of the Levensten Law Firm, PC, filed the short form complaint in the Yaz/Yasmin/Ocella master docket at the Philadelphia Court of Common Pleas.

The lawsuit states that the plaintiff, Kaitlan Dolly, 22, took Yaz from about January 2007 to November 2009. The medication had been prescribed by a medical professional.

On Aug. 17, 2009, the plaintiff had to have her gallbladder removed, the lawsuit states, a necessity that she blames on her use of the birth control pill.

The defendants named in the lawsuit are the Bayer Corp., Bayer Healthcare, LLC, Bayer Pharmaceuticals Corp., Berlex Laboratories, Inc., Bayer Schering Pharma AG and Bayer Healthcare Pharmaceuticals.

The lawsuit accuses the defendants of strict liability, breach of implied warranty of merchantability, breach of implied warranty of fitness for a particular purpose, negligent failure to warn, negligence, negligent misrepresentation, breach of express warranty, fraud and violations of consumer protection laws.

The plaintiff prays for relief as set forth in the master long form Yaz/Yasmin/Ocella complaint in common pleas court.

A jury trial has been demanded.
