A Texas woman who used denture adhesive cream for more than four decades is suing the product’s makers for injuries she alleges were a direct result of the products’ use.
Philadelphia attorney Lee B. Balefsky, of the firm Kline & Specter, filed the mass tort claim June 27 at the Philadelphia Court of Common Pleas on behalf of Elaine Travis of Dallas.
According to the lawsuit, Travis used SuperPoligrip from about 1967 to 2010 and Fixodent during roughly the same time period, after which she discovered she suffered from zinc toxicity and extensive nerve damage resulting in neuropathy, tingling and numbness of feet, which she alleges was caused by her use of the denture adhesive creams.
Named as defendants in the lawsuit are Smithkline Beecham Corp., Glaxosmithkline Consumer Healthcare, LLC, Block Drug Company, Inc., The Procter and Gamble Distributing LLC, and The Procter and Gamble Manufacturing Co.
The plaintiff accuses the defendants of negligence, strict liability-design defect, strict liability-failure to warn, breach of implied warranties, common law fraud and gross negligence and malice.
The plaintiff, who has demanded a jury trial, prays for relief as set forth in the denture adhesive cream master long form complaint.
The case number is 110602514.
