A Philadelphia man is suing a Chester Springs, Pa. couple who owns a piece of city property for injuries the plaintiff suffered after falling on faulty sidewalk at the premises.
The slip-and-fall lawsuit was filed June 27 at the Philadelphia Court of Common Pleas on behalf of Thomas Benton.
Named as defendants are John and Denise Miller.
According to the premises liability complaint, Benton was walking along the defendants’ property at 340 S. 15th St. in Philadelphia on April 29, 2010, when he fell due to a broken piece of sidewalk, sustaining various physical injuries, mental anguish and humiliation.
The lawsuit states that as a result of the fall, Benton may incur financial expenses due to required medical treatment.
The incident caused Benton to suffer shoulder and back injuries that have caused him “great pain and agony,” which will prevent him from carrying out his daily activities and labors.
The lawsuit accuses the defendants of negligence in permitting a dangerous condition to exist on their property, and for failing to post warning notices of the property’s condition.
The plaintiffs demand judgment against the defendants, jointly and severally, in an amount not in excess of $50,000.
The non-jury matter is scheduled for an arbitration hearing March 1, 2012.
