A woman whose estate alleges her death was directly attributed to the use of the drug Trasylol has had a mass tort lawsuit filed on her behalf.
Mississippi attorney Martin D. Crump filed the mass tort complaint June 27 at the Philadelphia Court of Common Pleas.
The plaintiff in the case, Phyllis Gipson, is in charge of the estate of Alberta Harper, a Kansas City, Mo. woman who was given the drug Trasylol at St. Luke’s Hospital in Kansas City in January 2002, only to die a short time later.
Trasylol is an anti-bleeding drug used during surgical procedures.
The lawsuit claims that the decedent suffered renal failure requiring “painful and debilitating medical treatments,” multiple organ failure requiring the same, emotional injury, stress, anxiety, distress, fear, pain, suffering, financial loss and death all related to the use of Trasylol.
The defendants listed in the lawsuit are Bayer Corp., Bayer Healthcare Pharmaceuticals, Inc., and Bayer Schering Pharma AG.
The lawsuit contains counts of negligence, negligent misrepresentations, wrongful death, survival action, injury and punitive damages.
The plaintiff demands compensatory damages, punitive damages, disgorgement of profits and restitution of all costs, attorney’s fees and interest.
A jury trial has been demanded.
