Icy patch at gas station leads to premises liability lawsuit

A Conshohocken, Pa. man who slipped on a patch of ice at a local gas station is suing the business owner for injuries he sustained after taking the spill.

Plymouth Meeting, Pa.-based attorney Richard C. Senker filed the slip-and-fall civil lawsuit June 28 at the Philadelphia Court of Common Pleas on behalf of Anthony Traveline and his wife, MargaretAnn.

The defendants named are Charlottesville, VA-based Liberty Petroleum and Albert Torcini, Jr., the owner of the Liberty Gas station at 2014 Butler Pike in Plymouth Meeting.

According to the lawsuit, Anthony Traveline was in the process of buying gas at the Liberty station on Feb. 1, 2011 when he suddenly slipped on a patch of ice near the pumps and fell to the ground.

As a result of his fall, the plaintiff suffered a number of unspecified physical and psychological injuries that have required him to undergo medical treatment.

The lawsuit states that the defendants should have ensured that the property where the incident took place was safe for public use.

As a result of the accident, Anthony Traveline has suffered severe physical and emotional pain, mental anguish, humiliation, embarrassment, inconvenience and a loss of life’s pleasures, the suit states. He has also suffered a loss of job earnings.

Anthony Traveline seeks judgment against the defendants in an amount in excess of $50,000, plus related costs.

The plaintiff’s wife, MargaretAnn Traveline, has a loss of consortium claim in the lawsuit in which she, too, seeks a judgment against the defendants in an amount in excess of the arbitration limits, which is $50,000, plus interest and court costs.

The non-jury matter has not yet been scheduled for arbitration.
