A New Jersey woman is suing the makers of the Yasmin birth control pill, alleging she sustained physical injury after taking the prescription medication for a four-year period.
Kimberly Hall, 43, of Edgewater Park, N.J. alleges in her complaint that she was diagnosed with a pulmonary embolism and right-sided deep vein thrombosis on or about Jan. 7, 2010.
The complaint, which was filed Nov. 7 at the Philadelphia Court of Common Pleas by attorney Martin G. Rubenstein, claims that negligence on the part of the defendants led to the plaintiff’s condition.
The defendants named in the lawsuit are Bayer Corporation, Bayer Healthcare LLC, Bayer Pharmaceuticals, Berlex Laboratories, Berlex Inc. and Bayer Schering Pharma AG.
The lawsuit accuses the defendants of fraudulent concealment, strict liability, breach of implied warrant of merchantability, breach of implied warranty of fitness for a particular purpose, negligent failure to warn, negligent design defect, negligent misrepresentation, negligence, breach of express warranty, fraud and violations of consumer protection laws.
In her lawsuit, which was filed as a short-form complaint, Hall prays for relief as set forth in the Plaintiff’s Amended Master Long Form Complaint in the Yaz, Yasmin, Ocella Gianv Litigation at Common Pleas Court.
