An Illinois woman who claims she sustained injuries after taking the diet drug commonly known as Fen-Phen has filed a mass tort claim against the drug’s makers in a Pennsylvania court.
Attorneys from the Philadelphia firm Kline & Specter filed the injury claim May 8 at the Philadelphia Court of Common Pleas on behalf of Gillespie, Ill. resident Liza Valido-Shade and her husband, Tim Shade.
The defendant named in the litigation is Wyeth Pharmaceuticals and various company subsidiaries.
According to the short-form complaint, which was filed in the master Fen-Phen litigation at Common Pleas Court, Valido-Shade, 41, was diagnosed in May 2010 with Pulmonary Arterial Hypertension, an injury she blames on her use of the diet drug Fen-Phen, which is formally known as Fenfluramine/Dexfenfluramine/Phentermine.
The complaint states that Valido-Shade was prescribed the drug by a physician with the New Image Doctor’s Weight Loss Clinic.
Valido-Shade used the drug for a year-long period between 1996 and 1997, the suit claims.
The lawsuit accuses the defendants of negligence, strict liability, breach of implied and express warranties and fraud.
There is also a loss of consortium count on behalf of Tim Shade.
The plaintiffs seek damages as set forth in the master Fen-Phen litigation.
