Man who lost vision when sign struck face sues Phila.-area Metro PCS store

A Philadelphia man who claims he lost permanent vision in his left eye after being struck

in the face by a sign outside of a Metro PCS store in nearby Delaware County has filed a personal injury claim against the business in state court.

Attorney John Trotman, Jr., of the Philadelphia firm Silverman Trotman & Schneider, filed the civil action June 14 at the Philadelphia Court of Common Pleas on behalf of George Cardwell of Northeast Philadelphia.

The defendant named in the suit is the Metro PCS store at 927 E. Baltimore Ave. in East Lansdowne, Pa.

According to the complaint, Cardwell was walking along the sidewalk near the store on Nov. 7, 2011, when a sudden gust of wind blew the defendant’s sign into his face causing Cardwell to sustain various physical injuries.

The facial injuries included eye pain, blurred vision, diminished vision, loss of vision and related issues, the complaint alleges.

The suit accuses Metro PCS of negligence for allowing a dangerous condition to exist on its property, failing to maintain a safe walkway at or near its business, obstructing or making hazardous a previously safe walkway by placing a sign in an unsafe manner, failing to properly train its employees on maintaining a safe walkway, creating an unreasonably dangerous and/or hazardous condition, and failing to provide adequate warning of the unsafe condition.

As a result of his injuries, Cardwell experienced significant pain and suffering, and he suffered anguish, inconvenience, a loss of life’s pleasures, lost earning capacity and disfigurement, the suit claims.

Cardwell seeks damages in excess of $50,000, plus attorney’s fees, costs and expenditures, sums, delay damages, pre-and-post-judgment interest and other court relief.

The plaintiff has demanded a jury trial.
