A 56-year-old Philadelphia man who claims his colon cancer is a direct result of having
been exposed to asbestos fibers during his working years has filed a mass tort claim against companies engaged in the manufacture and distribution of asbestos-containing products.
Philadelphia attorney Edward M. Nass filed the short-form complaint June 19 at the Philadelphia Court of Common Pleas on behalf of Albert T. Lauber and his wife, Theresa Gordie.
The suit claims that Lauber was diagnosed with colon cancer on Dec. 16, 2011, of which asbestos exposure was a factual cause.
Lauber claims he was exposed to asbestos while working as a painter for McCauley & Co. from 1972 to 1974, and also while performing automotive repair work during the 1970s and 1980s.
Discovery and investigation is continuing to ascertain whether Lauber was exposed to asbestos in any other occupational or non-occupational settings throughout his adult life, the suit states.
The lawsuit was filed as a short-form complaint in the master asbestos litigation at Common Pleas Court.
The defendants named in the lawsuit are Honeywell International Inc., Borg-Warner Corp., Genuine Parts Co., Georgia Pacific, Kaiser Gypsum Co., Keeler/Dorr-Oliver Boiler Co., Metropolitan Life Insurance Co., Pep Boys, Pneumo-Abex Corp., and Union Carbide Corp.
The plaintiffs reside in Southwest Philadelphia.
