An airport worker who claims the bones in his right foot were crushed when a fellow
employee operating an airport tug accidentally ran over the plaintiff’s foot has filed a personal injury claim against his employer.
Bala Cynwyd, Pa. attorney Marc S. Rosenberg, of the firm Mammuth & Rosenberg, filed the civil action June 20 at Philadelphia’s Common Pleas Court on behalf of Philadelphia resident Edward Arroyo.
The defendants named in the lawsuit are Tempe, AZ-based US Airways Inc. and US Airways Group Inc.
According to the complaint, Arroyo, who was an employee of Aircraft Service International Group Inc. at the time, sustained fractures and other injuries to his right foot back on June 9, 2011, after an airport tug being operated by an employee of the defendants suddenly and without warning ran over the plaintiff’s foot.
The incident occurred while Arroyo was standing on the tarmac at Philadelphia International Airport between gates B-15 and B-16.
The injuries required Arroyo to wear a cast on his foot for four weeks, followed by a brace for two weeks, the suit states.
Arroyo also sustained various cuts, bruises, and severe nerve damage.
The complaint alleges that Arroyo incurred financial losses due to his need to obtain medical attention.
He has been unable to attend to his daily duties and activities since the accident and he has suffered pain, mental anguish and humiliation, the suit alleges.
The complaint accuses the defendants of negligence for failing to properly operate and control an airport tug, driving too fast for conditions, failing to keep a proper lookout, failing to properly train employees and personnel and other negligent acts.
Arroyo seeks damages in excess of $50,000, plus interest and court costs.
The plaintiff seeks a trial by jury.
