A Philadelphia woman who claims she sustained a fractured leg and other injuries after she tumbled down the stairs at a city recreation center has filed a personal injury claim against the City of Philadelphia and its recreation department.
In her civil action, filed last week at the Philadelphia Court of Common Pleas by attorney David B. Sherman of the firm Solomon, Sherman & Gabay, Gayle Holder claims that she became injured on July 6 of this year, mere days before the suit was filed, after she tripped and fell down the front steps of the Kendrick Recreation Center, which is located in Roxborough, a Northwest Philadelphia neighborhood.
As a result of the incident, the lawsuit claims, Holder sustained serious personal injuries to her right foot, avulsion fracture of the distal fibula, ankle injuries, soft tissue swelling and lower back pain.
Holder incurred $1,500 in medical bills to treat her injuries, the suit claims.
The woman has also experienced great pain and suffering, a loss of earnings capacity and a loss of the enjoyment of life’s pleasures, according to the complaint.
The lawsuit accuses the defendants of negligence for allowing the area where Holder was injured to remain in a dangerous and defective condition, failing to clear the dangerous condition, failing to post barricades and warnings to secure the area while it was defective and failing to provide a safe pathway.
Holder seeks $50,000 in damages.
