A Jewish nonprofit organization that provides social services to those in needy communities is suing a rental community that offers housing for low-income, elderly residents, claiming the defendant has failed to pay for services provided by the plaintiff.
Philadelphia-based Jewish Family and Children’s Service of Greater Philadelphia claims in its civil action, which was filed Aug. 8 at Philadelphia’s Common Pleas Court by attorney Michael D. LiPuma, that Brith Sholom House Inc. has yet to compensate the plaintiff for services provided to the defendants’ residents under a contract the two parties entered into back on March 18, 2011.
The lawsuit alleges that the defendant has not paid the plaintiff for services rendered between March and November of last year.
“Plaintiff provided services in good faith with the assumption that the agreement would be honored,” the suit states.
The complaint says that the plaintiff executed its responsibilities “professionally” while serving the defendant’s needs, and that despite repeated requests, the defendants have failed to pay the fees due for those services.
The suit claims that the defendant owes the plaintiff $46,660.58, which is the amount of damages being sought in the civil action.
The plaintiff also seeks costs and attorney’s fees.
The lawsuit contains counts of breach of contract, unjust enrichment and quantum merit.
