A New Jersey man whose Philadelphia property was subject to a sheriff’s
sale has filed a petition in Pennsylvania state court seeking to have the office of Philadelphia Sheriff Jewel Williams fork over $10,000 in proceeds the plaintiff claims he is owed from the sale.
Ferriol C. Apistar, who currently resides in Voorhees, N.J., filed the motion to compel the sheriff of Philadelphia County to make a distribution of funds held in its possession on Sept. 20.
The legal filing states that the sheriff sold the plaintiff’s 3747 North Park Avenue home on Aug. 19 of this year at a tax sale.
The home was sold for a total of $12,000, but the plaintiff claims the amount owed in back taxes to the City of Philadelphia was only $2,000.
Apistar claims he is owed the $10,000 difference.
“To date, the Sheriff of Philadelphia has failed and refused to remit the $10,000.00 owed to Petitioner that is in its possession,” the civil action reads.
The plaintiff seeks to have a Philadelphia Common Pleas Court judge order the Sheriff’s Office to distribute and deliver the $10,000 to Apistar’s attorney, Gregory J. Allard, of J. Scott Watson P.C. in Glen Mills, Pa.
The petition does not state whether or not the North Park Avenue structure was owner-occupied, although it appears as though the plaintiff may be an out-of-state landlord.
The petition also does not specify what type of structure the property was, either residential or commercial.
