An Elkins Park man says that employees of a Pathmark supermarket in Philadelphia should have been aware of the slippery floors in the frozen foods section that caused him to fall to the floor and severely injure himself.
Newtown Smith, of the 8000 block of New Second Street in Elkins Park, seeks compensation in excess of $50,000 from the retail chain and its parent company, the Great Atlantic and Pacific Tea Company, Inc., based in New Jersey. According to the complaint, Smith was in the store located on Cottman Ave. when he stepped on a wet patch in the refrigerated aisle and fell to the ground.
Due to the alleged negligence of the store's management to warn him of the conditions and to properly train the staff to remove hazardous obstacles, Smith says, he sustained injuries to his knee, spine, ankle and back. Since the incident, Smith has suffered severe pain and suffering and incurred costly medical expenses while losing potential earning power.
