A 95-year-old Pennsylvania woman has filed a suit in the Philadelphia Court of Common
Pleas against a Bucks County Walmart after suffering injuries from a collapsed chair in the customer service area.
Sylvia Levay, of Philadelphia, says she sustained extensive injuries to her shoulder, elbow and ankle and has experienced mental anguish, embarrassment and humiliation. She seeks damages in excess of $50,000 for Walmart's alleged negligence.
According to the complaint, Levay arrived at the Bensalem store on June 10, 2012, to help her daughter return a microwave oven at customer service. While her daughter spoke to a clerk, Levay sat down on one of the benches. The chair immediately collapsed, the documents say, causing Levay to fall on her left side.
Levay blames the store for either carelessly failing to regularly inspect and repair the chair, or knowing the chair was defective and doing nothing about it.
